This End User License Agreement ("Agreement") is a legal agreement between you ("you", "End User") and BodyBioLog LLC ("Application Provider", "we") governing your use of the BodyBioLog mobile application (the "Licensed Application").
BodyBioLog is also subject to our Terms of Service, Privacy Policy, and Health Disclaimer, which are incorporated by reference into this Agreement.
1. Acknowledgment
You acknowledge that this Agreement is between you and BodyBioLog LLC only — not Apple Inc. or Google LLC — and that BodyBioLog LLC, not the App Store or Play Store provider, is solely responsible for the Licensed Application and its content. The terms of this Agreement may not provide for usage rules less restrictive than the Usage Rules set forth in the App Store Terms of Service or Google Play Developer Distribution Agreement as of the date you acquired the Licensed Application.
2. Scope of license
We grant you a non-transferable license to use the Licensed Application on any Apple-branded or Google-Play-compatible device that you own or control, subject to the Usage Rules of the relevant store. The license does not include the right to:
- Make the Licensed Application available over a network where it could be used by multiple devices at the same time.
- Rent, lease, lend, sell, redistribute, or sublicense the Licensed Application.
- Reverse engineer, decompile, modify, or create derivative works of the Licensed Application or any part of it.
3. Maintenance and support
BodyBioLog LLC is solely responsible for providing maintenance and support services for the Licensed Application as specified in this Agreement, in our Terms of Service, or as required by law. Apple and Google have no obligation to furnish any maintenance or support services.
4. Warranty
BodyBioLog LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed.
In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any) for the Licensed Application. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the sole responsibility of BodyBioLog LLC.
5. Product claims
BodyBioLog LLC, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
6. Intellectual property rights
In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, BodyBioLog LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such infringement claim.
7. Legal compliance
You represent and warrant that (i) you are not located in a country subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.
8. AI content
The Licensed Application includes AI-generated content. You acknowledge that AI output is observational and educational only — not medical advice, diagnosis, or treatment. AI may produce inaccurate or incomplete information. Always consult a licensed healthcare professional before making any health-related decision based on the Licensed Application's output.

10. Third-party terms
You must comply with applicable third-party terms when using the Licensed Application, including the App Store Terms of Service, Google Play Developer Distribution Agreement, and any wearable provider terms (Apple HealthKit, Health Connect, Oura, Garmin) as applicable.
11. Third-party beneficiary
You acknowledge and agree that Apple Inc. and Apple Inc.'s subsidiaries, and Google LLC and Google LLC's subsidiaries, are third-party beneficiaries of this Agreement, and that, upon your acceptance of the terms and conditions of this Agreement, Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this Agreement against you as a third-party beneficiary thereof.
12. Governing law
This Agreement is governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles, and is subject to the dispute-resolution provisions in our Terms of Service.
