Please read these Terms of Service ("Terms") carefully before using the BodyBioLog mobile application (the "App") operated by BodyBioLog ("we," "us," or "our").

1. Acceptance of Terms

By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Description of Service

BodyBioLog is a health and wellness tracking platform that enables users to:

• Track nutrition, meals, and macronutrients
• Log workouts and physical activity with GPS tracking
• Monitor health metrics from wearable devices (Oura Ring, WHOOP, Apple Watch, Garmin)
• Follow coach-assigned protocols (supplements, peptides, lifestyle items)
• Communicate with an assigned health/wellness coach
• View AI-generated nutrition insights and recipe suggestions
• Track progress photos, lab results, and goals

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. You are responsible for all activity that occurs under your account. Notify us immediately if you suspect unauthorized use of your account.

4. Health Disclaimer

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE.

All content provided through the App — including AI-generated nutrition recommendations, coach suggestions, protocol items, wearable data analysis, health scores, and educational content — is for informational and educational purposes only.

The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

• AI Recommendations: The AI Nutrition Coach uses artificial intelligence (OpenAI) to provide meal analysis and recipe suggestions. These recommendations are automated, may contain errors, and should not be treated as medical or dietary prescriptions.
• Coach Relationship: The coach-client relationship within the App is a wellness coaching relationship, not a doctor-patient relationship. Coaches are not acting as licensed medical professionals through the App unless separately licensed and disclosed.
• Wearable Data: Data from connected devices (Oura Ring, WHOOP, Apple Watch, Garmin) is provided by the respective device manufacturers. We do not guarantee the accuracy of wearable data. Do not use wearable data to make medical decisions.
• Supplements & Protocols: Any supplement or protocol information displayed in the App is provided by your coach or entered by you. We do not endorse, verify, or guarantee the safety or efficacy of any supplement, peptide, or protocol. Consult a qualified healthcare provider before starting any new supplement regimen.
• Emergencies: If you are experiencing a medical emergency, call your local emergency number (911 in the US) immediately. Do not rely on the App in emergency situations.

5. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to other users' data
• Reverse engineer, decompile, or disassemble the App
• Upload malicious code or interfere with the App's operation
• Use the App to harass, abuse, or harm another person
• Impersonate any person or entity
• Use the App to provide medical diagnoses or treatment

6. Intellectual Property

The App, including its design, code, features, and content, is owned by BodyBioLog and protected by intellectual property laws. You retain ownership of your personal data. By using the App, you grant us a limited license to process your data as described in our Privacy Policy.

7. Third-Party Services

The App integrates with third-party services including Oura, WHOOP, Apple HealthKit, Google Health Connect, OpenAI, and Open Food Facts. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or security of third-party services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BODYBIO LOG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH, ARISING OUT OF YOUR USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Indemnification

You agree to indemnify and hold harmless BodyBioLog from any claims, damages, losses, or expenses arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms. You may delete your account at any time through the App or by contacting us. Upon termination, your right to use the App ceases immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the Effective Date and, where appropriate, through in-app notification. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
